A Cumberland County Superior Court judge has awarded $50,000 to the family of Kenneth Drouin, of Windham, a beloved father and employee of SeaBee Electric Company who died in a tragic accident in January 2005.
In the accident, a Volkswagen Jetta driven by Randy Wilbur, of Page Road in Windham, struck Drouin’s truck as it lay stalled in the middle of Pope Road. Standing outside the truck at the time, Drouin was pinned under the automobile by the collision and died instantly.
Wilbur’s insurer, Kemper Auto and Home Insurance, settled the suit in March, granting the Drouin family $50,000.
The settlement money will go directly to Drouin’s children, Brandon and Caitlin.
But this settlement is not adequate for the loss endured by the Drouin family, said Peter Thompson, an attorney representing the family.
On behalf of Drouin’s wife Jennifer and their children, Thompson is seeking further compensation for the family through litigation against Drouin’s insurer, State Farm Insurance. This compensation includes past and future damages incurred from emotional distress and loss of income.
“We’re just glad there’s some additional coverage,” Thompson said. “It won’t be adequate, but we’ll do everything we can to help them out.”
State Farm Insurance has denied the claim, but Thompson hopes to settle the suit out of court.
