PORTLAND — A Waterboro man charged with selling a family member’s guns through a third party and then buying more firearms entered a guilty plea to four counts of possession of a firearm by a felon during an appearance before Judge Nancy Torresen at U.S. District Court in Portland Wednesday.
Anthony Foglio, 27, of Waterboro, convicted in state court two years ago of stealing a $90,000 trailer later found 270 miles away in Washington County, paid a third party to sell the guns in May 2012, according to an affidavit on file at the federal court. A couple of days later, the third party bought guns and turned them over to Foglio.
The maximum prison term on each of the four counts is 10 years in federal prison. According to a plea agreement, Foglio has pledged not to appeal any sentence of 84 months ”“ seven years ”“ or less. According to the court documents, the 84-month figure “doesn’t necessarily constitute an estimate of the sentence the parties expect will be imposed.”
Sentencing is scheduled for Sept. 6.
Foglio has been in federal custody since his arrest last fall.
According to the court documents, an individual who was not named in the affidavit told Alcohol, Tobacco, Firearms and Explosives agent Jon Forte that four guns were sold at Foglio’s request to a commercial establishment in Maine and that Foglio had carried two of them into the store. The individual received $1,500 for the firearms, gave Foglio the proceeds and was paid $60 for making the sale. The affidavit states that Foglio later admitted taking the guns without his family member’s permission.
Court papers show additional firearms sales to other businesses. As well, on May 27 and May 30, 2012, Foglio and the unnamed person made stops at two licensed firearms dealers, with the unnamed person buying a .38 caliber revolver at the first store and a 40 caliber pistol and a Ruger handgun at another store. The documents say Foglio took immediate possession of the firearms after the transaction.
Foglio was barred from possessing firearms because of his convictions at York County Superior on Court May 13, 2011 for receiving stolen property, burglary and theft, and aggravated criminal mischief. He was sentenced to four years in prison, with all but 150 days suspended, and placed on two years probation in connection with that incident.
York County Sheriff’s deputies in November 2010 said Foglio was among three men who had stolen a $90,000 Kubota tractor and trailer; $30,000 worth of snowmobiles and trailers; and a GMC truck valued at $6,000. The tractor, stolen from ATV Construction in Alfred, was traced to Vanceboro, about 270 miles away in northern Washington County, and authorities believed it was ultimately headed for Canada.
