The name of the driver of the vehicle in a Buxton traffic fatality on Dec. 4 has been released in a police report, but police said Thursday the incident was not a hit and run as was first reported.

The police report said Lori L. Marston, 43, of 465 Long Plains Road in Buxton, struck Ethel W. Lewis, 76, of 743 Long Plains Road at 6:15 a.m. Buxton Police Chief Jody Thomas said Thursday it was not a hit and run accident as police first believed. Thomas said the Marston remained at the scene.

No charges had been filed as of Thursday. But Buxton police are expected to submit the case to the York County District Attorney’s office for review.

Lewis died later in the afternoon after being taken to Maine Medical Center in Portland. Lewis had been struck while crossing the road in front of her home to get a newspaper. Police said Lewis was carrying a flashlight.

A police report on the day of the accident said that an unknown vehicle and driver had fled the scene, traveling in a direction of the intersection of Groveville and Haines Meadow Road.

The police report by investigating Buxton Officer Jason McClure on Dec. 8 said Marston swerved to avoid Lewis but struck the woman. The accident was reported at 6:23 a.m. and police were on the scene two minutes later.

Marston was driving a maroon 1999 Dodge van. Police said the van sustained $2,000 in damage. Marston owned the van.

Lewis was well known in the community. She was the wife of Wilmot “Bill” Lewis, a former Buxton selectman.
