The Standish Land Use Code specifically defines a warehouse as a “building used primarily for the temporary storage of goods and materials.” The code defines a building as “any structure designed or intended for the support, enclosure, shelter or protection of persons, animals, chattels or property.”

There has been no dispute that the Pit Stop Fuiel site plan contains what Mr. Lampron called a “bulk plant” for heating fuel. This bulk plant consists of large storage tanks (a building as defined by the code) that temporarily store oil (temporary storage of goods) until it is loaded into trucks for off-site delivery. The Town of Standish has classified the bulk plant as “retail use” because, it maintains, there is no other applicable definition listed in the Code.

How can the bulk plant, the temporary storage of heating fuel, not be considered a warehouse by the Standish Land Use Code?
